13 Legislators Collaborate in Same Sex Divorce Case
Thirteen state legislators have come together to issue a "friend of the court" brief for a case currently being considered in the Wyoming Supreme Court.
This case involves a same sex couple that is seeking a divorce in the state. However, since they were married in Canada in 2006 and the state does not issue same-sex marriages, the court could refuse to grant them a divorce. The thirteen justices involved in the brief are hoping to persuade the justices to grant a divorce to the women, Victoria Lee Christiansen and Paula Christiansen.
Their case was first reviewed last November by District Judge Keith Kautz who denied them the divorce. He stated that there was no basis in state law that granted him the authority to legally provide the Christiansen's with the divorce. Although Wyoming law recognizes marriage as a contract "between a man and a woman" it does recognize marriages that are issued outside of the state.
If the Supreme Court rules in favor of the women it could mean a huge victory for same sex couples.
