Tricky Alimony Case Heard by Courts
Although it was an unconventional argument to say the least, one man was granted the right to stop paying spousal support when his ex-wife started living romantically with a teenage boy.
The man brought his case to court where a judge granted his request to stop payments of $1,200 per month. The termination of alimony was based on evidence that the ex-wife, 46, was living with the teenage son that her parents had taken in as a foster child.
Since that relationship fell under the category of a former spouse living in a "marriage-like" cohabitation with another person, the ex-husband was not under obligation to make the payments.
Despite her relationship, the ex-wife fought back, of course, denying that she was having a relationship with the young boy. She brought her case to the state Supreme Court, which finally ruled in her favor. The justices stated that even if she was having a relationship with the boy, his age prevented him from helping her financially.
