How to Serve Divorce Papers

Are you planning on getting a divorce in California? If so, then you will probably need to serve divorce papers to your spouse. This can come to a shock to an unsuspecting spouse or can just be a point of heartbreak and disappointment for a spouse who assumed that the divorce papers were coming. In most situations, filing for divorce is confusing and complicated. That’s why it is best to have a local divorce attorney there to help you as you start out the process. Chances are that you will need to two forms that you will need to fill out in order to serve papers.

Depending on whether or not you have children and excessive property there may be more forms. These forms are found online and they are at your local court. When you obtain each of the necessary forms, you will want to make three copies. One of these copies will go on your own records, one will go to the Clerk of Courts, and one will be served to your spouse so that he or she can agree and fill out the needed information.

The forms that all men and women need for divorce in California are the Form FL-100 Petition for Dissolution of Marriage and a Form FL-110 Family law summons. As well, you may need a Form FL-105 Declaration under Uniform Child Custody Jurisdiction and Enforcement Act. If you have property which you will need to divide, then you will probably need to obtain a Form FL-160 Property Declaration. You may also need a proof of service form and may need someone to act as a process server. A family law attorney can help you to determine which forms are necessary for your specific divorce. Contact a Los Angeles family attorney today for more information or to get more advice on how to fill out these documents and kickstart your divorce.
