Annulment vs. Divorce

Are you contemplating divorce? Or, would you rather file for an annulment? While it is possible to have your marriage annulled in any state, the law can make it difficult for most people to qualify for an annulment.

When you ask for an annulment, you are asking the court to say that your marriage is not legally valid. Instead of a divorce where you simply end the marriage, an annulment will essentially erase your marriage completely, as though it never existed. There are general rules under which most states will grant an annulment.

If you can prove that your marriage was incestuous, bigamous (one spouse has a marriage/partnership with another person that is thought to be missing/dead), or one spouse is under 18 years of age, you may qualify for an annulment in your state of residence.

In order to learn if you meet the qualifications for an annulment or should consider divorce instead, contact Claery & Hammond, LLP today to arrange a time to speak with a knowledgeable Los Angeles family lawyer about your options.
