Restraining Order Sought in Violent Case
Posted By Claery & Green

What started as a threat at a children's football practice turned into an entire legal ordeal in the Washington County District Court. Mother Julie Fena asked for, and was initially denied, a restraining order against Commander Brian Mueller, who in turn asked for and was granted a restraining order against her husband.

Back in October Christopher Fena threatened to kill Mueller at their son's practice. Although some might see this as two parents getting a little hot under the collar, Fena was actually charged with felony terroristic threats against a law-enforcement official. He also violated an existing restraining order against his own wife when he spoke to her about the restraining order she planned to file against Mueller.

Fena voiced her fear that since Mueller is a police officer, he carried a gun, and is a greater risk to her and her children. The judge denied her petition but did order a hearing for November 17. Commander Mueller was awarded the restraining order as he feared Christopher Fena's known "drug use, threats, and highly erratic behavior".

Judge Issues Restraining Order to Protect Sarah Palin
Posted By Claery & Green

This week in Anchorage, Alaska, a judge has decided to issue a six-month protective order against a man from the state of Pennsylvania who stands accused of stalking former Alaska Governor Sarah Palin.

Allegedly, Judge Suzanne Cole ruled that 18-year-old Shawn Christy had stalked the 2008 GOP vice presidential candidate.  The judge ordered Christy not to follow Palin.  He was also told that he could not have communication with her or her family.

The newest order was issued after a 20 day restraining order was instated last month.

According to Palin's attorney and Palin herself, the 18-year-old threatened her on the phone.  He told her he was buying a one-way ticket to Alaska and sending her a receipt for a gun purchase.  Palin said in court papers that she was fearful Christy's behavior would result in her being injured or killed.

  Candi Spelling Obtains Restraining Order
Posted By Claery & Green

Multiple news sources have confirmed that Candy Spelling, mother of celebrity Tor Spelling, has been awarded an order of protection.  Reports indicate that Spelling's attorney filed for a restraining order in Los Angeles County Superior Court.  In the papers, it is alleged that Diyahmi Farrakhan Muhammad had been caught trespassing on Spelling's Holmby Hills estate at least nine times throughout recent months.

Most recently, the 38-year-old was found on the grounds on Tuesday and was taken into police custody.  Since then, he has been placed on psychiatric hold said news site, TMZ.

In the legal paperwork that was filed, Spelling says that Muhammad, "delusionally believes he personally knows and communicates with the Spellings."  She also said that the late Aaron Spelling contacted him "through the television" and invited him to live at the Beverly Hills estate.

Now, Muhammad has been ordered to stay at least 91 meters from Spelling and her mansion.

Heidi Montag Files for Restraining Order Against Her Mother
Posted By Claery & Green

According to popular news outlet TMZ, Heidi Montag has said that she plans to file for a restraining order against her own mother.  When asked why she wanted to file a restraining order, the 23 year old told reporters, "My mom just showed up to the house unannounced … and after what she did to me on national TV, I have no desire to see her."

The drama between Heidi and her mother has been unfolding for quite some time.  Most of the arguments and conflict have been captured by the show Montag stars on, "The Hills".

TMZ claims that the police were called to Montag's residence after her mother, Darlene Egelhoff, refused to leave the property.  Montag requested assistance from her security team after her mother began pounding on her door repeatedly, which led to police being called to the Hollywood Hills residence.

Montag later told TMZ that she plans to file for a restraining order against her mother.

  Restraining Orders: An Overview
Posted By Claery & Green

Victims of domestic violence often consider their situation hopeless. If you or a loved one is being abused by a spouse, girlfriend or boyfriend, parent, sibling, grandchild, or relative, you should know there are ways you can prevent this abuse from continuing to occur. One of the ways you can protect yourself from domestic violence is by filing for a restraining order.

Restraining orders specifically state which actions the abuser is prohibited from taking against the victim. For example, many restraining orders state the abuser is not to contact the victim at work, home, school, church, or any other place they typically frequent, and must remain a certain distance away from the victim at all times. A restraining order also prevents an abuser from making contact with the victim, whether in person, over the phone, through email, online, or via text message.

Types of Restraining Orders

There are several different types of restraining orders, including:

  • Emergency Protective Orders
  • Domestic Violence Temporary Restraining Orders
  • Criminal Protective Order
  • Civil Harassment Order
Restraining orders have proven to be effective in protecting domestic violence victims and reducing the rate of violence and abuse. If you are considering filing for a restraining order, a Los Angeles family law attorney at Claery & Green can help. An attorney at the office can determine which type of restraining order you should file for, and make sure all the necessary paperwork is filed out correctly to ensure you are protected as quickly as possible.
