Documents to Change After Divorce

If you get a divorce, there are several documents that you will want to alter after the divorce has been settled.

Wills & Trusts

First of all, it is important that you change all testamentary documents such as wills and trusts that need to be updated and beneficiaries that need to be changed. Also, it is important that you change all beneficiaries on any life insurance policies, bank accounts, stock accounts, and health savings accounts. This is especially true if the individual listed as a beneficiary on these accounts is your former spouse.

Retirement Accounts

Once this is done, you will need to move on to retirement accounts. These include IRAs and 401(K)s. Unless you take action with these documents, funds may roll over to your ex-spouse long after you have divorced. It is also important that you draft quit claims deeds and have them signed, notarized and recorded of you are planning to shift the owner of the property as a part of the divorce settlement.

Banks, Lenders & Utilities

In some divorces, it is essential to refinance documents that may need to be executed at the bank or to remove one spouse's name from the mortgage on the marital home if that individual plans to relocate. Sometimes you may need to change the name on the utilities accounts, as well. This includes expenses like the telephone and electricity. These need to be changed into the name of the person who is keeping the home.

Personal Accounts & Identification

If you are an ex-wife of a divorce settlement and plan on reverting back to your maiden name, then you will want to get a certified copy of the divorce degree in order to change your bank accounts, driver's license, passport, and other documents.
