California Guardianship Petitions for Families Who Need a Clear Path Forward
When a child’s parents can’t provide care, another adult often steps in. Making that arrangement legally recognized requires a guardianship petition through California’s probate court. The process involves specific filing requirements, notice rules, and a court hearing, and it unfolds in a division of the Superior Court that most families have never encountered. At Claery & Hammond, LLP, we walk Los Angeles families through each step, explaining what’s required and why, so nothing catches them off guard.

What Legal Guardianship of a Minor Means in California
Legal guardianship is a court-established relationship that gives an adult other than a parent legal authority to care for a minor child. Courts grant it when parents are unable to provide care due to illness, incapacity, military deployment, incarceration, or death. Grandparents, adult siblings, aunts and uncles, and other trusted adults commonly petition for guardianship in these situations.
One important distinction: guardianship doesn’t permanently sever a parent’s rights the way adoption does. Parents may retain visitation rights and, in some cases, a financial support obligation. If circumstances change significantly, the court can modify or end the arrangement.
Guardianship of the Person vs. Guardianship of the Estate
California recognizes two distinct types of guardianship, and understanding the difference matters when deciding what to petition for.
Guardianship of the Person
This grants the guardian authority over the child’s daily care, education, and medical decisions. It’s the form most families pursue when a parent is temporarily or permanently unable to care for a child.
Guardianship of the Estate
This authorizes a guardian to manage a child’s money or property until the child turns 18. It’s a separate legal role from guardianship of the person and becomes relevant when a minor stands to inherit assets or receive a settlement.
One person can hold both roles simultaneously, or the court can appoint separate individuals for each. Courts also distinguish between temporary guardianship, a short-term order that stays in effect until the next scheduled hearing, and permanent guardianship, which generally continues until the child turns 18 or the court terminates it.
How Guardianship Cases Move Through the Los Angeles Probate Court
Guardianship petitions for minors in Los Angeles County are filed with the Superior Court’s Probate Division, not family court. The procedures, filing locations, and judges involved are different, and that distinction matters. The Stanley Mosk Courthouse serves as the primary filing location, though hearings may occur at other Superior Court locations depending on where the child resides.
California Probate Code Sections 1510–1517 and 1540–1543 govern who may file a petition and what notice must be provided to parents, grandparents, and other interested parties before a hearing can proceed. The notice requirements alone trip up many petitioners who aren’t familiar with the rules. Once a petition is filed, the court evaluates it under the best interest of the child standard, weighing the child’s physical, emotional, and developmental needs when deciding whether to grant the petition.
The court may also order a background investigation into the proposed guardian’s home environment. When parents consent, the process typically moves faster. A contested guardianship, where a parent or other party objects, requires more evidence and a more involved hearing.
Guardianship vs. Custody, Adoption & Conservatorship
Families in these situations sometimes aren’t sure which legal path fits their circumstances. A brief comparison helps clarify the options.
- Guardianship vs. custody: Custody determinations are made between a child’s legal parents. Guardianship gives a non-parent legal authority over a child when parents can’t fulfill that role.
- Guardianship vs. adoption: Adoption permanently terminates the biological parents’ legal rights. Guardianship can be modified or ended if the situation changes, and parental rights generally remain intact.
- Guardianship vs. conservatorship: Conservatorship applies to adults who can’t manage their own personal or financial affairs. Guardianship applies to minors.
If you’re unsure which of these fits your situation, a guardianship lawyer can help you identify the right path before you file anything.
